Charges & Payments

Should your usage of our services incur charges from a Third Party officially licensed by SMS BEE, the terms agreed upon between you and said Third Party will apply. These terms represent a legally binding agreement between you (the customer) and SMS BEE, outlining disclaimers, liability limits, and indemnification provisions. By selecting “I accept these terms and conditions” and proceeding with your request or service registration, you hereby agree to the following:

  • You commit to paying all Customer Charges for accessing and utilizing the Service, as outlined here, through the prepayment method.
  • For service utilization, customers are required to purchase credits, which are deducted based on message type and length.
  • Digital payment methods (e.g., mobile banking, debit/credit card, digital wallet) may incur additional processing fees.
  • Invoices will reflect only the actual product/service price without payment processing charges.
  • Additional transaction processing fees might be deducted via your chosen payment method during online payments.
  • Direct Bank Deposit, Bank Transfer, and Cash deposit at our Office incur no extra charges or processing fees.
  • Account-to-account credit transfers are not supported.
  • If the products/services are taxable, government-mandated taxes will be added to the principal amount.
  • Billing is conducted in BDT Taka (Bangladeshi Taka) in accordance with Service Specific Terms and Conditions.

Account Activation

The person signing up for the Service assumes the role of the contracting party (“Account Owner”) under our Terms of Service. This individual is authorized to use any accompanying account provided by SMS BEE for Service access. If you’re registering on behalf of your employer, they become the Account Owner, and you confirm your authority to bind your employer to these terms.

Upon registration completion, a SMS BEE account is created using the provided information. Approval of the application depends on your documents, and the SMS BEE authority’s decision.

The signing of the “Terms and Conditions” form, along with required documents, may be necessary.

Definitions

  • Application to Person (A2P) SMS: Mobile/system-generated SMS not sent via mobile devices. A2P includes One-way SMS, OTP, PIN codes, etc., delivered by alpha sender/masking, numeric sender-id, shortcode, etc.
  • SMS Aggregator: An SMS service provider like SMS BEE that offers SMS services to organizations on behalf of telecom operators.
  • Promotional SMS: Brand/organization-generated SMS conveying marketing info.
  • Transactional SMS: Automated system-generated SMS sent during customer activity, e.g., transfers, OTPs.
  • Notification SMS: Auto alerts about account activities, purchase confirmations, etc.
  • One-way SMS: System-generated SMS for promotions, transactions, or notifications.
  • Two-way SMS: Customer responds after receiving SMS.
  • Toll-free SMS: Customer-incurred bill is paid by the organization.
  • Sender-ID/Masking: Brand name/ID in SMS.
  • Group-based SMS: Targeted SMS based on factors.
  • Other SMS: All non-Person to Person (P2P) SMS.

Systems and Services

  • SMS BEE provides A2P SMS services as per BTRC tariff.
  • Contracted with ANS Operators and MNP Service Providers for bulk SMS.
  • SMS types allowed include A2P, bulk SMS, group-based SMS, etc.
  • A2P SMS must be in Bangla; exceptions with BTRC permission.
  • Content filtering and customer responsibility enforced by SMS BEE.

Obligations

  • No religiously provocative or anti-state SMS allowed.
  • Restrictions on election-related SMS content.
  • Separation of promotional and transactional SMS to bypass DND service.
  • Account Cancellation and Termination – Various reasons listed.

Force Majeure

  • Neither party liable for delays caused by events beyond reasonable control.

Governing Law & Dispute Resolution

  • These terms are governed by Bangladesh law. Jurisdiction in Bangladesh High Courts.
